Operating Under the Brand QuicklyBooked

These Terms of Service (“Terms”, “Agreement”) constitute a binding agreement between Automations Lab LLC, operating under the brand QuicklyBooked (“QuicklyBooked”, “we”, “us”, “our”), and any individual or entity accessing or using the QuicklyBooked platform (“Client”, “User”, “Customer”, “you”).

By accessing or using the Service, Client acknowledges that they have read, understood, and agree to be bound by this Agreement.

1. Definitions

For purposes of this Agreement, the following terms shall have the meanings below:

1.1 “Service” refers to the QuicklyBooked cloud-based scheduling, booking, and business management platform provided by Automations Lab LLC.

1.2 “Platform” refers to the software environment through which the Service is delivered, including proprietary systems and trusted third-party technology partners.

1.3 “Client Data” means all data, customer information, content, and materials uploaded or transmitted by Client through the Service.

1.4 “Lifetime License” means a perpetual software access license provided for the duration in which QuicklyBooked continues to operate the Service, as further described in this Agreement.

1.5 “Hosting, Security & Support Plan” (“Hosting Plan”) means the mandatory operational service plan required for the active functioning, hosting, security, performance, and support of the Service.

1.6 “External Services” means third-party services or systems integrated into or used in connection with the Service, including payment processors, calendar tools, communication systems, and other APIs.

1.7 “Agreement” means these Terms of Service and any policies, documents, or schedules expressly incorporated herein.

2. Acceptance of Terms

By using the Service, Client agrees to comply with this Agreement.

If Client does not agree, they must immediately discontinue use of the Service.

3. Service Overview

QuicklyBooked provides a cloud-based software platform enabling appointment scheduling, customer management, notification delivery, and related business functions.

The Service is delivered through a combination of proprietary systems and third-party technology infrastructure.

Features, integrations, and system components may evolve over time as part of ongoing platform development.

4. Account Registration and Responsabilities

4.1 Client must provide accurate, current information during registration and maintain confidentiality of login credentials.

4.2 Client is fully responsible for all activity occurring under their account, whether authorized or unauthorized.

4.3 QuicklyBooked shall not be liable for any loss arising from unauthorized access resulting from Client’s failure to secure account credentials.

5. License Grants

For purposes of this Agreement, the following terms shall have the meanings below:

5.1 Lifetime License

The Lifetime License grants Client perpetual rights to access and use the QuicklyBooked software platform under the plan level purchased.

The Lifetime License guarantees:

• no recurring software licensing fees;
  
• continued activation of purchased plan level;
  
• ongoing software updates applicable to that plan;
  
• perpetual access for the duration in which QuicklyBooked operates the Service.
  

The Lifetime License does not include hosting, security, infrastructure, data backups, communication channels, or support services, all of which are provided exclusively through the Hosting Plan.

5.2 Rent-to-Own License

Where applicable, Rent-to-Own plans grant full access during the payment term.

Upon completion, the Lifetime License is activated.

Missed or failed payments may result in service suspension.

6. Mandatory Hosting, Security & Support Plan

6.1 All active Client accounts require an active Hosting Plan.

This Plan is essential for:

• cloud hosting and system uptime;
  
• SSL and security monitoring;
  
• automated backups;
  
• notification delivery infrastructure (email, SMS, WhatsApp)
  
• domain and DNS support;
  
• system maintenance and updates;
  
• access to resource templates (email, marketing, social media);
  
• 24/7 AI support and human escalation support.
  

6.2 Support

Support includes instructions, guidance, configuration assistance, and troubleshooting.

Support does not include implementation on behalf of the Client or managing their business operations.

6.3 Effect of Hosting Plan Cancellation

If the Hosting Plan is cancelled:

• the Lifetime License remains valid;
  
• however, Client acknowledges that the Service will not be functional or accessible without hosting;
  
• backups, notifications, integrations, and security services cease;
  
• Client Data may become unavailable or inaccessible.
  

7. Software Development and Modifications

QuicklyBooked may update, enhance, modify, or discontinue features as part of normal software evolution.

Such modifications may include:

• UI/UX updates;
  
• performance upgrades;
  
• revised or deprecated integrations;
  
• new features available on higher-tier plans.
  

These changes do not entitle Client to refunds, credits, or compensation.

8. Third-party Services

The Service may interact with External Services.

Client acknowledges and agrees that:

• External Services operate under their own terms and policies;
  
• QuicklyBooked has no control over third-party changes, outages, pricing, or performance;
  
• QuicklyBooked is not liable for failures or limitations of External Services;
  
• Use of External Services is entirely at Client’s discretion.
  

9. Acceptable Use Policy

Client agrees not to:

• use the Service for unlawful, harmful, or fraudulent purposes;
  
• transmit spam, malware, or unauthorized communications;
  
• interfere with or disrupt system performance;
  
• reverse engineer, copy, or replicate the Platform;
  
• circumvent usage limitations or security measures;
  
• misuse External Services or exceed reasonable operational limits.
  

Violations may result in immediate suspension or termination.

10. Client Data

10.1 Client retains ownership of all Client Data.

10.2 Client is solely responsible for obtaining consent from their customers and for complying with all applicable privacy laws.

10.3 QuicklyBooked processes Client Data solely to provide the Service.

10.4 QuicklyBooked does not guarantee full data recovery in cases of deletion, system cancellation, or External Service failures.

A separate Privacy Policy governs data processing.

11. Fees and Payments

11.1 All payments for Licenses, Hosting Plans, and Optional Services are final, non-refundable, and non-transferable.

11.2 QuicklyBooked may update pricing on its website at any time.

Pricing changes do not affect previously purchased Lifetime Licenses.

11.3 Failed or reversed payments may result in immediate suspension.

12. Term, Suspension, and Termination

12.1 Client may terminate use of the Service at any time.

12.2 QuicklyBooked may suspend or terminate access if:

• Client violates this Agreement;
  
• Client engages in fraudulent, abusive, or illegal conduct;
  
• payments fail or are reversed;
  
• Client poses a security risk.
  

No refund shall be provided in such cases.

13. Warranty Disclaimer

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise.

QuicklyBooked does not warrant that:

• the Service will be error-free or uninterrupted;
  
• the Service will meet Client’s business goals or revenue expectations;
  
• integrations or features will remain available indefinitely.
  

All implied warranties are expressly disclaimed.

14. Limitation of Liability

To the maximum extent permitted by law, Automations Lab LLC shall not be liable for:

• lost revenue, profits, or anticipated savings;
  
• lost bookings or business opportunities;
  
• data loss or corruption;
  
• system downtime or outages;
  
• failures of External Services;
  
• indirect, incidental, special, punitive, or consequential damages.
  

Client’s exclusive remedy is to discontinue use of the Service.

15. Indemnification

Client agrees to indemnify and hold harmless Automations Lab LLC from any claims, liabilities, damages, losses, or expenses arising out of:

• Client’s misuse of the Service;
  
• violation of this Agreement;
  
• breach of laws or regulations;
  
• misuse of Client Data or third-party integrations
  

16. Governing Law

This Agreement shall be governed exclusively by the laws of the State of Wyoming, without regard to conflict of law principles.

17. Binding Arbitration

17.1 Any dispute arising out of or relating to this Agreement shall be resolved exclusively through binding arbitration, administered by a recognized arbitration authority and conducted in accordance with its commercial rules.

17.2 Client waives the right to litigate in court, including the right to a jury trial.

18. No Class Action

Client agrees that:

• all disputes shall be resolved individually;
  
• class actions, representative actions, and collective proceedings are expressly prohibited;
  
• the arbitrator may not consolidate claims or preside over class-based disputes.
  

19. Force Majeure

QuicklyBooked shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, outages, cyber-attacks, labor disputes, or third-party failures.

20. Assignment

QuicklyBooked may assign or transfer this Agreement without restriction.

Client may not assign rights or obligations without written consent.

21. Severability

If any provision is deemed unenforceable, the remaining provisions shall remain in full force.

22. Waiver

Failure to enforce any provision shall not constitute a waiver of that provision.

23. Entire Agreement

This Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements, representations, and understandings relating to the Service.

In the event of conflict between this Agreement and any other document, this Agreement shall prevail.
